Introduction

These Terms of Use ("Terms") govern your use of the imgarc Chrome extension ("Extension", "Service", or "we"). By installing and using the Extension, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Extension.

Acceptance of Terms

By downloading, installing, or using the Extension, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Extension on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Service Description

imgarc is a Chrome extension that provides image processing capabilities, including downloading images in various formats, reverse image searching with multiple engines, viewing EXIF/metadata, and compressing images. The Extension is provided "as is" and "as available" without warranties of any kind.

User Account

Some features of the Extension may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

User Conduct

You agree to use the Extension only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Extension in any way that violates any applicable laws or regulations.
• Use the Extension to infringe upon the intellectual property rights of others.
• Attempt to gain unauthorized access to any part of the Extension or its related systems or networks.
• Use the Extension to transmit any malware, spyware, or other harmful code.
• Interfere with or disrupt the integrity or performance of the Extension.

Intellectual Property Rights

The Extension and its original content, features, and functionality are owned by imgarc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Extension, except as permitted by these Terms.

User Content

You retain ownership of any content you submit, post, or display through the Extension. By submitting, posting, or displaying content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content in any existing or future media formats.

Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE EXTENSION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE EXTENSION OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMGARC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE EXTENSION.

Indemnification

You agree to defend, indemnify, and hold harmless imgarc, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Extension.

Termination

We may terminate or suspend your access to the Extension immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Extension will immediately cease.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which imgarc is established, without regard to its conflict of law provisions.
